All contracts of sale made by Safety Factory whether made by post, telephone or via electronic order on our website, shall be deemed to incorporate these terms and conditions, which shall prevail over any other terms with any party ("the Customer") with whom Safety Factory is dealing.
All featured prices exclude VAT and delivery. Goods and services, together with VAT, are invoiced in pounds sterling, at the price prevailing at time of order (unless a VAT exemption is applicable). Safety Factory reserves the right to modify the prices from time to time without prior notice. Account facilities for Customers are available subject to conditions (see payment options).
3.1 Any time or date stated for delivery is an estimate only. Safety Factory makes every effort to despatch goods on time but does not accept liability for failure to deliver within the stated time.
3.2 A standard packing and carriage charge will be added at the published rate for order values under £75 exc. VAT. (Excluding S.Ireland, Scottish Highlands, non UK mainland addresses and international orders, where carriage will be charged at cost.)
3.3 Safety Factory does not accept liability for shortages or damage to deliveries unless the Customer notifies us in writing within five working days of receipt.
3.4 The Customer has to accept the goods when they are ready for delivery; delivery is deemed to take place when the goods are delivered to the Customer's nominated address, whereupon the risks of loss, breakage and all damage shall pass to the Customer.
3.5 Title in the goods does not pass to the Customer until payment is received in full by Safety Factory.
3.6 A POD (Proof of Delivery) must be requested within two months from invoice date.
4.1 Customer payment options: An account facility is available (click here to apply for a credit account) for business and professional establishments where payment is due 21 days from the date of invoice. Credit card, we accept Mastercard, Visa, Delta, Switch and JCB. For posted orders, pre-payment with order by cheque or postal order (a 2% discount is given on all pre-payment orders (excluding credit card payments).
4.2 Failure to comply with the stated payment terms may result in an "Account Facility" being withdrawn.
4.3 If payment is not made on time, Safety Factory may charge interest daily on the outstanding balance at 2.5% above the Bank base lending rate calculated on a daily basis.
5. Product Specification
5.1 Safety Factory makes every effort to supply products or goods as advertised but reserves the right to vary actual dimensions, specifications and quantities without prior notice.
5.2 In the event that Safety Factory cannot supply the goods ordered by the Customer, Safety Factory reserves the right to supply goods of equal or superior quality at no extra cost.
Safety Factory is committed to providing our customers with the highest quality products and service. However, on rare occasions products we supply may be found to be faulty or defective. In keeping with our commitment to providing you with excellent service, we offer the following returns facilities for stock items. Special provisions apply to Special Order Items, which cannot be returned without the express agreement of Safety Factory.
6.1 Subject to verification by Safety Factory of any alleged fault, we will accept the return of defective products for full refund or replacement, if, but only if, the goods are returned within 14 days of purchase. On receipt of the returned product, we will test it to identify the fault you have notified to us. If following the testing process, the product is found to be without defect, we will return the product to you.
6.2 Safety Factory will only accept unwanted products for refund within 14 days of delivery, provided that the goods are in an unopened and re-saleable condition. Safety Factory reserve the right to charge carriage on all goods returned which were delivered in good faith against orders received.
6.3 Unless otherwise stated, all equipment delivered to UK mainland address carry a 12-month manufacturer's warranty. Customers who wish to make a warranty claim must comply with the manufacturer's instructions and warranty procedure. In order to expedite a resolution to your problem, we may refer you to the product manufacturer who will deal directly with the return. In these instances, we will provide you with the contact information for the relevant manufacturer.
6.4 Safety Factory Support Staff will advise you of which method of delivery to use to return the products. Depending on the nature of the product purchased, we will either arrange a courier collection of the product, or request that you return the product to us directly.
6.4.1 If we have arranged for a courier collection of your product, we are unable to specify the collection time. It is your responsibility to ensure that someone will be present when the courier arrives at the collection address.
6.4.2 If Safety Factory ask you to return it to us directly, proof of postage is not necessarily proof of delivery and you are therefore strongly advised to send your package by recorded delivery, registered post or courier and to maintain sufficient insurance to cover the value of the goods.
6.4.3 Safety Factory cannot accept liability for packages damaged during transit. It is your responsibility to wrap the product adequately to prevent damage occurring.
